- 1 General provisions
1.Online shop available on the website at https://www.woodlegs.pl is run by Woodlegs Company Sławomir Zabawiński, Kolonia Borowiecko, 97-545 Gomunice, ul. Lniana 18, NIP: 772 101 85 19, Regon number: 590421569, BDO number: 000219177, having the status of a small entrepreneur within the meaning of the Act of 8 March 2013 on counteracting excessive delays in commercial transactions (Journal of Laws of 2022, item 893, as amended).

2.Whenever the following terms are used in these Terms and Conditions they shall be understood to mean:
1) Woodlegs Company - Woodlegs Company Sławomir Zabawiński, Kolonia Borowiecko, 97-545 Gomunice, ul. Lniana 18, NIP: 772 101 85 19, Regon number: 590421569, BDO number: 000219177, having the status of a small entrepreneur within the meaning of the Act of 8 March 2013 on counteracting excessive delays in commercial transactions (Journal of Laws of 2022, item 893, as amended).
2) Online shop - the online shop operated by the Woodlegs Company and available on the website at https://www.woodlegs.pl ;
3) Customer - a natural person over the age of 13, whereby if such a person is under 18, the consent of his or her legal representative is required, unless such a person has full legal capacity, as well as a legal person or an organisational unit without legal personality, to which legal capacity is granted by law, which uses the On-line shop, in particular which places an order via the On-line shop under the terms of these Terms and Conditions;
4) Consumer - Customer who is a natural person who performs a legal action with Woodlegs Company not directly related to his/her economic or professional activity, in particular who places an order in the Shop;
5) Lead time - the number of working days Woodlegs Company completes the order placed by the Customer in the Online Shop, entrusts the ordered goods to the carrier and delivers the ordered goods via the carrier to the place indicated by the Customer in the order;
6) Working days - weekdays from Monday to Friday excluding public holidays;
7) Shop - the company shop run by Woodlegs Company located in Radomsko, Łódzkie Voivodeship in the territory of the Republic of Poland, in which Woodlegs Company offers goods for current sale.
8) Order - a declaration of will by the Customer, made via the Internet Shop, specifying: type and quantity of goods in the assortment of the Internet Shop at the time of placing the order, method of payment, method of delivery of the goods, place of delivery of the goods and the Customer's data, constituting an offer by the Customer to Woodlegs Company to conclude an agreement of sale via the Internet Shop of the goods that are the subject of the order;
- All goods in the online shop's range are brand new.
- In order to use the Online Shop, including browsing the range of products in the Online Shop and placing orders, it is necessary to meet the following minimum technical requirements:
(1) possession of a computer or other multimedia device with access to the Internet;
2) having a web browser:
- a) Internet Explorer version 11.0 or later with ActiveX, JavaScript and cookies enabled or
- b) Mozilla Firefox version 52.0 or later with Java applets, JavaScript and cookies enabled or
- c) Google Chrome version 56.0 or later with Java applets, JavaScript and cookies enabled or
- d) Opera version 43.0 or higher with Java applets, JavaScript and cookies enabled or
- e) Apple Safari 8.0 or later with Java applets, JavaScript and cookies enabled;
3) having an active electronic mail (e-mail) account;
4) Recommended minimum screen resolution of 1360 x 1024 pixels.
5.In order to ensure the security of messages and data transmitted on the Online Shop, Woodlegs Company takes technical and organisational measures appropriate to the degree of danger, in particular measures to prevent the acquisition and modification by unauthorised persons of personal data transmitted via the Internet. Woodlegs Company ensures the security of data transmission transmitted in the Online Shop by using the SSL (SecureSocketLayer) protocol.
6.The customer using the Online Shop is obliged to:
1) use the Online Store in a manner consistent with applicable law and the provisions of these Terms and Conditions,
2) use the Online Shop in accordance with good morals and with respect for the personal rights of others,
3) not to provide or transmit unlawful content,
4) use the Online Shop in a manner that does not interfere with its operation,
5) use any content posted within the Online Shop for his/her own personal use only,
6) to refrain from sending or posting unsolicited commercial information (spam) within the Internet Shop.
- 2 Registration and Login
- Woodlegs Company provides electronic services to enable Customers to set up and use a Customer Account on the website of the Online Shop at the following address https://www.woodlegs.pl .
- The Customer Account service consists of enabling Customers to use the functionality of the Online Shop after logging in.
- Registration of a Customer Account in the Online Shop is voluntary and free of charge.
- The Customer may browse the range of products in the Online Shop and place orders without registering a Customer Account. However, a Customer who has registered a Customer Account with the Online Shop has the possibility of: adding products to "favourites" and recommending them to friends, tracking order history, tracking order status.
- The Customer may register a Customer Account in the Online Shop by clicking on the homepage of the Online Shop at the following address https://www.woodlegs.pl icon representing a person in the top right-hand corner of the page or may register a Customer Account when placing an order via the Online Shop.
- Registration of a Customer's Account with the Online Shop requires filling in a registration form by providing an electronic mail address (e-mail address) and a password. In order to register a Customer Account, it is necessary for the Customer to read and accept these Terms and Conditions, as well as to consent to the processing of his/her personal data provided during registration, marked as obligatory. Provision of data marked as obligatory is necessary for the creation of a Customer Account, fulfilment and handling of orders placed in the Online Shop as well as for the proper performance of services provided electronically. The provision of data marked as mandatory is voluntary, but necessary for the creation of a Customer Account. The provision of non-mandatory personal data is voluntary and is not necessary for the creation of a Customer Account.
- After completing the registration form, the "Register" button must be pressed. Subsequently, a message confirming the registration of the Customer's Account will be sent by Woodlegs Company to the electronic mail address (e-mail address) provided in the registration form. The agreement on the provision of services by electronic means in the scope of enabling the Customer to set up and use a Customer Account on the Online Shop website shall be concluded at the moment when the Customer receives an electronic message confirming the registration of the Customer Account. The Customer Account service is provided free of charge for an indefinite period of time.
- Once the Customer Account has been registered, the Customer may log in to the Online Shop by entering the electronic mail address (e-mail address) and password indicated during registration.
- The Customer may terminate the Customer Account service agreement at any time, without stating a reason and without incurring costs, in particular by sending Woodlegs Company an e-mail to the following address kontakt@woodlegs.pl or in writing to the postal address of Woodlegs Company as indicated in § 1 point 1.1 of the Terms and Conditions, requesting the deletion of the Customer's Account together with an indication of the electronic mail address (e-mail address) currently registered in the Online Shop.
- Woodlegs Company may terminate the Customer Account service agreement with 14 days' notice for valid reasons, which include:
1) the Customer's use of the Online Shop in a manner that is in breach of the law or the provisions of these Terms and Conditions,
2) the Customer's use of the Online Shop in a manner that infringes the rights of third parties or is contrary to good morals,
3) Customer's use of the Online Shop in a manner that interferes with its operation,
4) sending or posting of unsolicited commercial information (spam) by the Customer within the Online Shop. - Woodlegs Company may make a declaration of termination of the Customer Account service agreement by sending the Customer a declaration of termination of the Customer Account service agreement by e-mail to the e-mail address (e-mail address) currently registered in the Online Shop.
- Termination of the Customer Account service agreement by either party, as well as termination of the Customer Account service agreement with the consent of both parties, will result in the blocking and removal of the Customer Account from the Online Shop.
- The termination of the Customer Account Service Agreement by either Party, as well as the termination of the Customer Account Service Agreement with the consent of both Parties, shall not affect the rights acquired by the Parties prior to termination or dissolution.
§3 Placing orders
- The Customer may purchase goods from the Online Shop's range by placing an Order. Orders may be placed twenty-four hours a day, seven days a week via the website of the Internet Shop. https://www.woodlegs.pl .
- A necessary element of the procedure of placing an Order is reading and accepting these Regulations by the Customer, which the Customer confirms by ticking the appropriate box before finalising the Order. If the Customer does not accept these Terms and Conditions in the course of the Order placement procedure, the possibility of purchasing goods via the On-line shop is precluded.
- As part of the procedure for placing the Order, the Customer also has to provide the personal data specified in the Order form, marked as mandatory, and consent, by ticking the appropriate box before finalising the Order, to the processing of the Customer's personal data provided during the Order placement process for the purpose of processing the Order placed with the Online Shop. Providing personal data marked as obligatory is voluntary, however, it is necessary for the purpose of placing the Order. Providing personal data not marked as obligatory is voluntary and is not necessary for placing the Order.
- In order to place an Order, it is necessary to use the website of the Online Shop to https://www.woodlegs.pl complete the Order, select the area and method of delivery of the goods, the method of payment, fill in the order form, and then validate and transmit the Order by pressing the "Confirm Purchase" button. By pressing the "Confirm Purchase" button, the Customer places an Order with the obligation to pay.
- The Customer completes the Order using the "Basket". By pressing the "Add to Cart" button, the Customer selects the goods in the range of the Online Shop at the time of placing the Order, according to their description and price, and selects the size if the goods are offered in different sizes. After pressing the "To checkout" button, the Customer selects the area and method of delivery of the goods, the method of payment and completes the Order form.
- The order form should indicate:
1) the name and address of the Customer,
2) the telephone number and electronic mail address (e-mail address) of the customer;
3) details of the consignee and the address to which the goods are to be delivered, if the ordered goods are to be delivered to an address other than the address of the Customer and to a place other than or a collection point. - A Customer who has registered a Customer Account with the Online Shop may place an Order using the Customer Account after logging in to the Online Shop.
- Goods ordered in the Online Shop may be delivered in the Republic of Poland and abroad, but shipping costs are determined individually.
- Information on the total value of the Order, which includes the price of the goods, is given in each case on the website of the Online Shop. https://www.woodlegs.pl during the course of the Order, including immediately before and at the time of the Customer's approval and submission of the Order. These are the total costs to be paid by the Customer including applicable taxes and delivery costs.
- During the Order placement procedure - until the moment of pressing the "Confirm Purchase" button - the Customer has the possibility to modify the Order, in particular with respect to the selection of the goods, the area and method of delivery of the goods, the method of payment, the data provided in the Order form. In order to modify the Order as regards the selection, the Customer has to press the "Edit" button visible on the website of the Internet Shop during the procedure of submitting the Order.
- The Order is placed when the Customer completes the Order, selects the area and method of delivery of the goods, the method of payment, fills in the order form, accepts these Terms and Conditions and provides the data necessary to complete the contract of sale of the goods. The Order is placed by pressing the "Confirm purchase" button by the Customer. An Order placed via the Online Shop entails the obligation to pay.
- By placing an Order by the Customer, the Customer is making an offer to Woodlegs Company to conclude an agreement for the sale of the goods which are the subject of the Order.
- Once the Customer has placed an Order, an email will be sent immediately by Woodlegs Company to the email address (email address) indicated on the Order form or in the Customer Account if the Customer has placed an Order using the Customer Account, confirming receipt of the Order and acceptance of the Order for processing. As soon as the Customer has received an e-mail from Woodlegs Company confirming receipt of the Order and acceptance of the Order for processing, the contract of sale between the Customer and Woodlegs Company shall be concluded. Confirmation, making available, recording, securing the content of the concluded contract takes place by sending to the Customer the above-mentioned electronic message with confirmation of receipt of the Order and acceptance of the Order for execution, together with attachments in pdf format in the form of these Regulations, instruction on the right to withdraw from the contract, specimen form of declaration of withdrawal from the contract,
- The Customer, who has chosen to pay in advance when placing the Order, should pay the price and the costs of delivery of the goods within 4 hours of receiving an e-mail from Woodlegs Company confirming receipt of the Order and acceptance of the Order for execution, as referred to in § 3 item 13 of these Regulations. In the event of non-payment within the aforementioned time, the Order shall be cancelled and information thereof shall be sent to the Customer. The Customer shall not incur any costs in connection with the cancellation of the Order.
- A Customer who has chosen payment on delivery of the ordered goods (cash on delivery) when placing an Order is obliged to make payment on delivery of the consignment containing the ordered goods.
- The provision of services by Woodlegs Company by electronic means to enable Customers to place Orders for goods offered by Woodlegs Company via the Online Shop is free of charge and of a one-off nature. The service shall be terminated either immediately after the Order has been completed by Woodlegs Company or when the Customer discontinues placing the Order via the Online Shop in advance.
- The Customer, who has placed an Order and has chosen cash on delivery, shall have the right to cancel the Order with the exception of products made to the Customer's order (the Customer shall have the contractual right to cancel the sales contract) until Woodlegs Company sends the consignment with the subject of the Order to the Customer. The declaration of intent to cancel may be made by contacting Customer Service at the following email address kontakt@woodlegs.pl or at the telephone number given under the "CONTACT" tab at the bottom of the website https://www.woodlegs.pl (charged as an ordinary telephone call, according to the tariff package of the operator whose services you use). The request will be handled during the opening hours of the Customer Service. The above-mentioned right to cancel the Order (contractual right of withdrawal) does not affect or limit the Consumer's right to withdraw from the contract within 14 days without giving any reason under the Consumer Rights Act of 30 May 2014, as referred to in § 7 of these Terms and Conditions.
- When ordering an individual product, oak products and bespoke products, the customer knowingly waives the right of withdrawal.
- 4 Commodity prices
- Prices of goods presented on the website of the Online Store are expressed in Polish zloty and are gross prices, i.e. they include taxes, including value added tax (VAT). The prices displayed on the web pages of the Online Store apply to one item of goods.
- The prices of goods given on the web pages of the Internet Shop do not include the costs of goods delivery. The costs of delivering the ordered goods are each time indicated on the webpage of the Online Store during the process of placing the Order, including directly before and at the moment of approving and placing the Order by the Customer, and are included in the total value of the Order. The total value of the Order includes the price of the goods and the costs of their delivery.
- Information about the price of the goods, the features, quality and essential characteristics of the goods is available on the website of the Online Shop and is provided next to the presented goods.
- The binding and final price shall be the price shown in the "Basket" in the summary of the Order at the time the Customer places the Order via the Online Shop.
- The prices of goods shown on the web pages of the Online Shop are valid only for placing orders via the Online Shop. For goods offered for sale in the Shop, the prices of goods displayed in the Shop shall apply.
- The prices of goods presented on the web pages of the Online Shop are subject to change, with the change in the price of goods not affecting orders placed before the price change took effect.
- 41Promotional campaigns
- On the pages of the Woodlegs Company Online Shop, promotions or sales (hereinafter referred to as Promotional Actions) may be organised.
- Promotional campaigns may consist in particular of:
a) the granting of a quota or percentage discount on a given good or category of goods in the Online Shop;
b)granting a quota or percentage discount on the cheapest or cheapest goods when purchasing a certain amount of goods from the Online Shop;
(c)the granting of a quota or percentage discount on the goods included in the set, purchased from the Online Shop. - Detailed terms and conditions of the Promotional Actions are announced before the start of a given promotion on the pages of the Woodlegs Company Online Shop.
- Promotional campaigns are part of the marketing activities carried out by the Woodlegs Company to promote Woodlegs Company branded goods.
- A participant in the Promotional Campaign may be a Customer who is a natural person aged 13 or over, whereby if such a person is under 18, the consent of his/her statutory representative is required, unless he/she has full legal capacity, who acts, during the term of the Promotional Campaign, as a consumer within the meaning of art. 221 Act of 23 April 1964 Civil Code (consolidated text Journal of Laws of 2022, item 1360, as amended), i.e. a natural person making a legal transaction with an entrepreneur which is not directly related to his/her economic or professional activity will make a purchase covered by a given Promotion Action ("Participant").
- The discount is calculated on the gross value of the promotional goods.
- Each Participant may take part in the Promotional Action more than once if he or she each time fulfils the conditions of participation in a given Promotional Action, unless otherwise expressly indicated in the detailed terms and conditions of a given Promotional Action.
- Woodlegs Company shall be entitled to introduce a maximum number of units of a given good or category of goods covered by a single Order or a given Promotional Action.
- The Promotional Action cannot be combined with other Promotional Actions, unless otherwise expressly stated in the detailed terms and conditions of a given Promotional Action. The above, in particular, means that promotional merchandise cannot be goods which have previously been discounted, sold out or for which a discount has been granted under another Promotional Action (unless otherwise clearly indicated in the detailed terms and conditions of a given Promotional Action).
- The value of the discount (the discount granted under the relevant Promotional Action) is not exchangeable for cash in whole or in part.
- If, as a result of withdrawal from the contract, the conditions of the discount granted under the given Promotional Action fall off, the Participant loses the right to the granted discount. In such a case, the Participant of the Promotional Action will be obliged, at his/her own discretion, to return the amount of the granted discount or to return the promotional product(s) for which the discount was granted. The above shall apply in particular when the subject of the Order is a promotional set (in such a case, the withdrawal from or cancellation of the Order can only concern the entire promotional set), as well as in the event when the purchase of a certain number of goods specified in the Promotion Action entitles to receive a discount.
- The rules of the Promotional Campaign may change during its duration, with the proviso that this shall not apply to agreements concluded prior to the change. In particular, the rules of the Promotional Campaign may be changed in the event of a change in the regulations relating to the organisation of the Promotional Campaign, extension of the duration of the Promotional Campaign or a change in the manner of carrying out the Promotional Campaign due to technical reasons.
- The date on which the Order is placed in accordance with these Terms and Conditions will determine the deadline for taking part in the Promotional Action.
- Promotional campaigns may run for a limited period of time, until further notice or until the pool of goods is exhausted.
- 5 Methods of payment of the price of the ordered goods and delivery charges
- The currently available payment methods, including electronic ones, are specified on the website of the Online Shop next to each product in the product description section. In addition, the currently available payment methods are presented for selection at the beginning of the Ordering procedure, before the Order is placed.
6 Fulfilment of orders, method and cost of delivery of ordered goods
- Goods ordered through the Online Shop are delivered in the Republic of Poland.
- Goods ordered via the Online Shop are delivered to the place indicated by the Customer in the Order on working days.
- Information on the cost of delivery of the ordered goods is given next to each product in the description section.
- The lead time for an Order placed via the Online Shop, if the ordered goods are to be delivered within the territory of the Republic of Poland, is 4 working days for products available in stock and 30 working days for individual orders and products made to the customer's order, counting from the day:
1) in the event that the Customer, when placing the Order, chooses payment on delivery of the ordered goods (cash on delivery) - from the date on which Woodlegs Company sends an electronic message to the Customer confirming acceptance of the Order for execution,
2) in the event that the Customer chooses to pay in advance when placing the Order - from the date on which Woodlegs Company receives confirmation of the correct execution of the payment by the payment processor. - In the aforementioned cases, 2 working days are set aside for completion of the Order and handover to the carrier for delivery to the place indicated by the Customer in the Order, and a further 2 working days are set aside for delivery by the carrier to the place indicated by the Customer in the Order.
- Once the goods have been ordered via the Online Shop, the Customer will be sent an invoice covering the subject of the Order.
- Subject to paragraph 14 below, the invoice referred to in paragraph 11 shall be delivered to the Customer in electronic form by sending an attachment containing the invoice in PDF (.pdf) format to the e-mail address referred to in § 3 paragraph 6 of these Terms and Conditions. Corrected invoices will be served in the same manner.
- By accepting these Terms and Conditions, the Customer consents to the sending of electronic invoices in the manner indicated in paragraphs 11 and 12 above subject to paragraph 14 below.
- A paper invoice covering the subject of the Order shall be sent upon the Customer's request. In order to receive an invoice, the Customer may send it to the following address: Woodlegs Company, Kolonia Borowiecko 97-545 Gomunice, ul. Lniana 18 or to the following e-mail address kontakt@woodlegs.pl. The request for a paper invoice shall include the Order number and the invoice delivery address. Corrections to invoices delivered to the Customer in paper form shall also be delivered to the Customer in paper form.
- The customer acknowledges that the waiting time for the ordered goods may change due to holiday breaks, public holidays, holiday leave, busy working periods in the run-up to the holidays, and may be extended accordingly by no more than 14 working days from the specified final dispatch date.
- 7 Right of withdrawal
- Pursuant to Article 27 of the Consumer Rights Act of 30 May 2014 (Journal of Laws of 2010, item 287. as amended), a Consumer who has concluded a remote agreement may, within 14 days, withdraw from that agreement without giving any reason and without incurring any costs, except for the costs specified in Section 7 and Section 8 below. A notice of the right of withdrawal, containing, in particular, information on how and when to exercise the right of withdrawal and on the costs of returning the goods in the event of withdrawal, which shall be borne by the Consumer, is attached as Annex 1 to these Regulations.
- The period for withdrawal shall begin:
1) for a contract in the performance of which Woodlegs Company delivers the goods, being obliged to transfer their ownership (e.g. a sales contract), from the taking possession of the goods by the Consumer or a third party other than the carrier designated by the Consumer and, in the case of a contract that includes multiple goods that are delivered separately, in batches or in parts, from the taking possession of the last good, batch or part,
2) for other contracts, from the date of conclusion of the contract. - The consumer may withdraw from the contract by informing Woodlegs Company of his/her decision to withdraw from the contract by way of an unequivocal statement, for example by sending a letter by post to the following address: Woodlegs Company, Kolonia Borowiecko, 97-545 Gomunice ul. Lniana 18 with the annotation "Return" or by sending this declaration by e-mail to: kontakt@woodlegs.pl The declaration of withdrawal may be made using the withdrawal form, the specimen of which is attached as Annex No. 2 to these Terms and Conditions, but it is not obligatory.
- It shall be sufficient for you to send your communication concerning the exercise of your right of withdrawal before the expiry of the withdrawal period.
- In the event of withdrawal from a distance contract, the contract shall be deemed not to have been concluded. If the Customer who is a Consumer has made a declaration of withdrawal before Woodlegs Company has accepted his offer, the offer shall cease to be binding.
- In the event of withdrawal from the contract, the Consumer must return the goods to Woodlegs Company immediately, but no later than within 14 days from the day on which the Consumer informed Woodlegs Company of the withdrawal from the contract. To meet the deadline, it is sufficient if the Consumer sends the goods back before the expiry of the 14-day period to the address:
Woodlegs Company 97-545 Kolonia Borowiecko, Gomunice, ul. Lniana 18, marked "Return". - The consumer shall bear the direct costs of returning the goods, in particular customs duties and taxes related to the return of the goods.
- In the event of withdrawal from the contract, Woodlegs Company shall, without delay and no later than 14 days from the date of receipt of the Consumer's declaration of withdrawal from the contract, reimburse to the Consumer all payments received from the Consumer, including the costs of delivery of the goods, but excluding the additional costs resulting from the delivery method chosen by the Consumer other than the cheapest ordinary delivery method offered by Woodlegs Company, subject to the case indicated in point 12 below.
- Refunds will be made by Woodlegs Company using the same means of payment used by the Consumer, unless the Consumer has expressly agreed to a different method of refund - in any event, the Consumer will not incur any fees in connection with the refund.
- Woodlegs Company may withhold reimbursement of payments received from the Consumer until it has received the goods back or the Consumer has provided evidence of the goods being returned, whichever event occurs first.
- The consumer shall be liable for any diminution in the value of the goods resulting from the use of the goods other than what is necessary to establish the nature, characteristics and functioning of the goods.
- Pursuant to Article 38 of the Consumer Rights Act of 30 May 2014 (Journal of Laws of 2020, item 287, as amended), the right of withdrawal from a contract concluded remotely does not apply to the Consumer in respect of contracts:
(1) for the provision of services where the trader has provided a service in full with the express consent of the consumer who has been informed before the performance begins that he will lose his right of withdrawal after the trader has provided the service;
2) in which the object of the performance is a non-refabricated good, produced to the consumer's specifications or intended to meet the consumer's personalised needs;
3) in which the object of the performance is perishable goods
4) where the subject matter of the performance consists of goods which are, by their nature, inseparable from other goods after delivery.
- 71 Contractual right of return within 90 days of purchase
- The customer may also withdraw from the contract after the expiry of the 14-day period referred to in § 7 above until the expiry of 30 days from the date of purchase, and then until the expiry of 90 days from the date of purchase of the goods, under the terms of this paragraph 7.1 ("Contractual right of return").
- The contractual right of return can only be exercised upon presentation of proof of purchase (receipt or invoice), provided that the returned goods bear no signs of use or mechanical damage. The contractual right of return cannot be exercised in the case of the purchase of personalised goods or goods tailored to the customer's individual needs (e.g. goods made from individual patterns, goods cut or elongated for the customer's needs and goods varnished according to the customer's preferences).
- The periods of 30 and 90 days for the return of the goods shall be calculated from the day following the date of conclusion of the contract of sale of the goods and shall expire in each case on the 30th or 90th day respectively, even if it is a public holiday or a Saturday. Therefore, the rules for calculating time limits in Article 115 of the Civil Code do not apply in this respect.

- The payment received from the Customer for the purchase returned under the Contractual Right of Return will be refunded:
a) if the goods are returned within 30 days of the date of purchase, the payment shall be refunded using the same means of payment as those used by the Customer in the original transaction; - The contractual right to return the goods does not affect or limit the provisions of the right of withdrawal under the Consumer Rights Act of 30 May 2014 (Journal of Laws of 2020, item 287, as amended).
- 8 Complaint handling procedure
- Woodlegs Company is obliged to provide the Customers with goods without defects, in accordance with the content of the contract. Woodlegs Company shall be liable to the Customers for non-compliance of the goods with the contract in accordance with the provisions of the Act of 30 May 2014 on Consumer Rights (Journal of Laws of 2020, item 287, as amended) in Articles 43a to 43g and also in the provisions of the Act of 23 April 1964 Civil Code (Journal of Laws 2022, item 1360, as amended), excluding the provisions of the third book of Title XI of Chapter II.
- A complaint may be submitted by the Customer, for example, directly at the Woodlegs Company Registered Office during its opening hours or in writing to the address of the Woodlegs Company Customer Service Office: Woodlegs Company 97-545 Kolonia Borowiecko, Gomunice, ul. Lniana 18, with the annotation "Complaint".
- It is advisable that the notification of the complaint contains, in particular: name and surname, correspondence address, electronic mail address (e-mail address) to which a response to the complaint is to be sent, if the Customer wishes to receive a response to the complaint by e-mail, date of purchase of the goods, type of goods under complaint, exact description of the defect and the date on which the defect was found, the Customer's request, as well as the Customer's preferred method of information on how the complaint will be handled. Along with the complaint, proof of purchase of the goods must be provided to Woodlegs Company. This may be, for example, a copy of the receipt or a copy of the invoice, a printout of the payment card or other proof. The above content concerning the complaint notification is only an example, which the Customer does not have to use, and it does not affect the effectiveness of complaints submitted with the omission of the recommended description of the complaint.

41 A customer who exercises his rights due to the non-conformity of the goods with the content of the contract may demand repair or replacement of the goods, subject to the reservations set out in Article 43d(2) and (3) and Article 43e of the Consumer Rights Act of 30 May 2014 (Journal of Laws of 2020, item 287. as amended). - Woodlegs Company will consider and respond to the complaint immediately, no later than within 14 days from the date of complaint. The Customer will be informed of the manner in which the complaint is dealt with in accordance with the data indicated in the complaint notification.
- Complaints concerning the Newsletter service or other services provided electronically, including irregularities in the operation of the Online Shop, can be submitted, for example:

2) by telephone, on the Customer Service telephone number, which can be found in the "CONTACT" section at the bottom of the website, together with its opening hours https://www.woodlegs.pl (charge as for a normal telephone call, according to the tariff package of the operator whose services you use). - A complaint regarding the Newsletter service or other services provided electronically should include, in particular: a description of the matter to which the complaint relates, the electronic mail address (e-mail address) provided during Customer Account registration or in the order form, and the electronic mail address (e-mail address) or correspondence address to which a reply to the complaint is to be sent, if the Customer wishes to receive a reply to the complaint by post or e-mail to an address which is different from the electronic mail address (e-mail address) provided during Customer Account registration or in the order form, as well as the Customer's preferred method of informing the Customer about the manner of processing the complaint. The above-mentioned content concerning the complaint notification is only an example, which the Customer does not have to use, and does not affect the effectiveness of complaints submitted without the recommended description of the complaint. The complaint will be considered and the Customer will be informed of the manner in which the complaint has been dealt with immediately, no later than within 14 days from the date of submission of the complaint. The Customer will be informed of the manner in which the complaint is dealt with in accordance with the data indicated in the complaint submission.
- If there are any deficiencies in the submitted complaint, Woodlegs Company will ask the Customer to complete them according to the address details indicated in the complaint.
- 9 Out-of-court complaint and redress procedures
- Detailed information about out-of-court procedures for handling complaints and pursuing claims, as well as rules of access to these procedures, are available at the offices and websites of district (city) consumer ombudsmen, social organisations whose statutory tasks include protecting consumers, voivodeship inspectorates of the Trade Inspection and at the following addresses of the Office of Competition and Consumer Protection:

- The European Consumer Centres Network also assists in resolving individual disputes and consumer complaints related to a cross-border transaction. Their addresses are available on the website of the European Consumer Centre https://konsument.gov.pl/.
- The Customer who is a Consumer shall have, among other things, the following options for the out-of-court resolution of a dispute between the Consumer and the Woodlegs Company:
1) Apply to the provincial inspector of the Trade Inspection to initiate proceedings for an out-of-court settlement of the dispute between the Consumer and Woodlegs Company by enabling the parties to bring the positions of the parties closer together in order to resolve the dispute by the parties thereto or to present the parties with a proposal to resolve the dispute,
2) shall be entitled to apply to the permanent court of arbitration operating at the provincial inspector of the Commercial Inspection for the settlement of a dispute arising from a concluded sales contract. - The Trade Inspection is an entity authorised to conduct proceedings on out-of-court settlement of consumer disputes. The tasks of the Trade Inspection as regards conducting proceedings on out-of-court settlement of consumer disputes and organising and conducting permanent arbitration courts are performed by the locally competent Voivodeship Inspectors of the Trade Inspection. - The consumer can use the online consumer dispute resolution platform (ODR platform) in accordance with Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013 on online dispute resolution for consumer disputes and amending Regulation (EC) No 2006/2004 and Directive 2009/22/EC (Regulation on ODR in consumer disputes).

- The Customer may agree to receive the Newsletter provided by Woodlegs Company. The Newsletter is sent only to those Customers who ordered the Newsletter by ticking an appropriate box in the registration form or order form and agreed to receive to the given e-mail address (e-mail address) commercial information within the meaning of the Act of 18 July 2002 on electronic services (i.e. Journal of Laws 2020, item 344).
- Within the Newsletter service, personalised and customised information in the form of an electronic letter (e-mail) is sent via e-mail to the e-mail address (address) provided by the Customer. The Newsletter contains in particular information about the offer of Woodlegs Company goods, new collections, current promotions and other information about the goods offered by Woodlegs Company. The newsletter is sent free of charge.
- The Customer may at any time, without stating any reason and without incurring any costs, change the indicated electronic mail address (e-mail address) to which the Newsletter is sent or unsubscribe from the Newsletter by pressing the Newsletter link located in the footer of each Newsletter, entering his/her electronic mail address (e-mail address) in the appropriate field and then selecting the "Unsubscribe" button.
- 11 Personal data and privacy policy

- In matters relating to data protection, the Customer or the Store User may contact our Data Protection Officer by writing to: kontakt@woodlegs.pl .
- The provision of personal data by Customers and Shop Users is voluntary, although in some cases it is necessary in order to make a purchase. Personal data of Shop Users will be processed for the purposes of registration in the Shop and, in the case of granting the relevant consent, for the marketing of our goods and services and participation in the Newsletter service (understood as the sending of commercial information electronically and with the use of telecommunication end devices - SMS, in accordance with the Act of 18 July 2002 on electronic service provision. In the case of purchase of goods, Customers' personal data shall be processed for the purpose of proper execution of the contract of sale of our goods, as well as their dispatch. Failure to provide personal data necessary to conclude a sales contract will result in the refusal to conclude the contract.
- The legal basis for the processing of personal data with regard to the Store User's registration in the online shop, marketing of goods and services and participation in the Newsletter service is the consent given, while in the case of the purchase of goods, the processing of data is necessary for the purpose of fulfilling the contract.
- Personal data will be stored until the Store User withdraws their consent or up to a maximum of 5 years from the completion of the Order, in the case of Customers.
- We will transfer the personal data of Shop Users to companies providing us with ICT and legal services, as well as those carrying out marketing activities for us. In the case of Customers, their data may also be passed on to companies which deliver goods.
61. In connection with Woodlegs Company's use of IT systems to support the operation of our business, there may be transfers of personal data to third countries, i.e. the United States of America, however, the transfer of this data and its processing in this territory is based on standard data protection clauses adopted by the European Commission, thus guaranteeing an adequate level of data protection. - Every Customer and Store User has the right to request from us access to their data, rectification (amendment), portability and deletion of their data, as well as the right to restrict data processing. In connection with our processing of personal data, the Customer and the Store User has the right to lodge a complaint with the President of the Data Protection Authority.
- Based on the personal data of the Customers and Shop Users, profiling will take place, i.e. on the basis of their activity on the site, viewed products, we will present to the Customers and Shop Users other products which may be of interest to them. Customers and Shop Users have the right to object to the above action at any time, in accordance with the provisions of the Privacy and Cookies Policy.
- You have the right to withdraw your consent to the processing of personal data that is processed on the basis of your consent at any time. The withdrawal of consent will not affect the lawfulness of the processing that was carried out on the basis of the consent given before its withdrawal.
- The Woodlegs Company online shop uses cookies, i.e. small text/number files which are saved by the ICT system in the User's ICT system (on the User's computer, phone or other device from which the Service was connected) when browsing the Service, including the sub-page "Online shop", and allow for subsequent identification of the User in the event of a repeated connection to the Service from the device (e.g. computer, phone) on which they were saved.
- Cookies collect data on the use of the Website, including the "Shop online" sub-page by the User, and their main purpose is to make it easier for the User to use the Website, to adapt the Website pages to the needs and expectations of a given User (personalisation of the sub-pages of the Website), and to study User traffic within the Website.
- Cookies are used on the Website with the User's consent. Consent may be given by the User through appropriate settings of the software, in particular the Internet browser, installed on the telecommunications device used by the User to view the content of the Website.

- 12 Ownership of the designs and the name
- Both the Woodlegs Company name, logo and products have been registered with the patent office.
- All products and images shown on the website https://www.woodlegs.pl/, are the property of the Woodlegs Company and the copying, downloading and use of Est is strictly prohibited. All rights reserved.
- Woodlegs Company owns all design rights to the products shown on the website. Violation of the following rules is subject to legal action and damages will be drawn. It is strictly forbidden to
- Counterfeiting of 1:1 design - The Woodlegs Company has the right to verify that the product used by someone has been purchased from the Woodlegs Company and to carry out any actions establishing impersonation of the Woodlegs Company by a company producing copies of designs belonging to the Woodlegs Company.
- Copying Woodlegs Company products - it is unacceptable to excessively model Woodlegs Company products by changing their original dimensions. E.g. If someone copies a product and changes only and up to the dimensions to a different one, he/she will also be subject to a penalty resulting from theft of intellectual property and exposing the Woodlegs Company to losses resulting from copying products belonging to the Woodlegs Company.
- Use of the Woodlegs Company name and logo to impersonate the company and mislead customers.
- Any infringement and theft of Woodlegs Company's intellectual property will be dealt with through the relevant institutions.
- 13 Final provisions
- Contracts concluded through the Online Shop are concluded in the Polish language.
- Information and price lists provided on the Internet Shop's website at https://www.woodlegs.pl/ referring to the goods presented in the Internet Shop do not constitute an offer within the meaning of the Act of 23 April 1964 Civil Code (consolidated text Journal of Laws of 2022, item 1360 as amended).
- Woodlegs Company honours all the Customers' rights provided for in the provisions of the applicable law, in particular those provided for in the provisions of the Act of 23 April 1964 Civil Code (consolidated text Dz. U. of 2022, item 1360, as amended) and the Act of 30 May 2014 on Consumer Rights (Dz. U. of 2020, item 287, as amended). The provisions of these Terms and Conditions are not intended to limit or exclude any rights of Customers under the law.
- These Terms and Conditions are available free of charge on the website of the Online Shop under the tab "Terms and Conditions" at the following address https://www.woodlegs.pl/regulamin-sklepu/, at the registered office of Woodlegs Company and in the Shop. The Regulations are made available on the above-mentioned website in a form, which makes it possible to acquire, reproduce and record the content of these Regulations by means of a tele-information system used by the Customer. Recording, securing and making available the content of the agreement concluded via the Internet Shop is performed by sending the content of the concluded agreement to the Customer's e-mail address provided within the scope of the transaction made in the Internet Shop.
- Woodlegs Company reserves the right to amend these Terms and Conditions for legal or organisational reasons. The Customers shall be informed about the content of the changes to the Rules and Regulations by posting them at the address of the Online Shop https://www.woodlegs.pl information on changes to the Terms and Conditions of Use, including a summary of the changes to the Terms and Conditions of Use, and maintenance of this information on the site of the Online Store https://www.woodlegs.pl for a period of at least 14 consecutive calendar days. In the event of changes to the Terms and Conditions relating to the provision of the Customer Account service or relating to personal data or privacy policy, Customers who have registered a Customer Account with the Online Store shall be additionally informed of such change to the Terms and Conditions by sending information containing a summary of the changes to the Terms and Conditions to the electronic mail address (e-mail address) provided in the registration form. Information on changes to the Terms and Conditions shall be provided no later than 14 calendar days before the change to the Terms and Conditions comes into effect. Amendments to the Terms and Conditions shall come into force on the date specified with the information about the amendment to the Terms and Conditions, but not earlier than 14 calendar days from the moment of informing about the amendment to the Terms and Conditions. The amended Terms and Conditions shall be binding for the Customer who has registered a Customer Account with the Online Shop, unless, in the case of non-acceptance of the changes to the Terms and Conditions, the Customer declares - within 14 calendar days from the date of receiving the information about the change to the Terms and Conditions - that he/she terminates the agreement for the provision of the Customer Account service in the manner specified in § 2 point 9 hereof.
- In the event of an amendment to these Terms and Conditions, all agreements concluded and Orders placed prior to the effective date of the amendment to the Terms and Conditions shall be executed in accordance with the Terms and Conditions in force on the date of conclusion of the agreement and placement of the Order by the Customer.
- The provisions of Polish law, in particular the Act of 23 April 1964 Civil Code (consolidated text of the Journal of Laws of 2022, item 1360, as amended), and, in the case of Customers who are Consumers, also the provisions of the Act of 30 May 2014 on Consumer Rights (Journal of Laws of 2020, item 287, as amended) shall apply to matters not regulated in these Terms and Conditions.
- Annexes to the Terms and Conditions are: Letter of Right of Withdrawal which is attached as Annex 1 to the Regulations and a model withdrawal form which is attached as Annex 2 to the Regulations.
- These Regulations shall enter into force on 1 January 2023 and shall apply to contracts concluded from that date.
INFORMATION ON THE RIGHT OF WITHDRAWAL
- Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period expires after 14 days from the date:
- on which you have taken possession of the goods or on which a third party other than the carrier and indicated by you has taken possession of the goods, in the case of a contract involving the transfer of ownership of the goods,
- on which you acquire possession of the last of the goods or on which a third party other than the carrier and indicated by you acquires possession of the last of the goods - in the case of a contract involving the transfer of ownership of multiple goods which are delivered separately,
- on which you acquire possession of the last lot or piece, or on which a third party other than the carrier and indicated by you acquires possession of the last lot or piece - in the case of a contract involving the transfer of ownership of goods delivered in lots or pieces,
- conclusion of the contract - in the case of service contracts.

You may use the model withdrawal form, but this is not obligatory.
In order to comply with the withdrawal period, it is sufficient for you to send your communication concerning the exercise of your right of withdrawal before the withdrawal period has expired.
- Effects of withdrawal
In the event of withdrawal from this contract, we shall reimburse you the payment for the goods ordered, without reimbursement of shipping costs, immediately and in any event not later than 14 days from the day on which we are informed of your decision to exercise your right of withdrawal from this contract.
We will refund your payment using the same means of payment as you used in the original transaction, unless you have expressly agreed otherwise; in any event, you will not incur any charges in connection with this refund.
We may withhold reimbursement until we receive the goods or until you provide us with proof of return, whichever event occurs first.

You will have to bear the direct costs of returning the goods, in particular customs duties and taxes related to the return of the goods.
You shall only be liable for any diminution in the value of the goods resulting from your use of the goods other than what was necessary to establish the nature, characteristics and functioning of the goods.
